Two writ petitions have been filed in the Court of Appeal requesting the court issue an order disqualifying Minister of Rural Development, Social Security and Community Empowerment Dr Upali Pannilage and Jaffna District Independent MP Dr Ramanathan Archchuna as MPs.

The petitions have been filed by Abhinawa Niwahal Peramuna Chairman Oshala Herath, who argues that the said MPs should be disqualified from their posts as parliamentarians as they were still in government service when they contested the last general election.

The petition against Minister Dr Pannilage states that he was still working as a Professor at the Department of Sociology of the Ruhuna University when he was appointed to Parliament on the National List. Dr Archchuna meanwhile, was still working as a government medical officer at the time he was elected to Parliament from the Jaffna District, the petition against him alleges.

The petitioner notes that as per election law and the Constitution, the two should have resigned from government service before standing for election.

The petition against Dr Archchuna was called before Justices Sobitha Rajakaruna and Mahen Gopallawa. The court ordered the case to be taken up again on January 15.
